Chief Justice Martha Koome’s Call for Integrity in IEBC Selection Process
The Chief Justice and President of the Supreme Court of Kenya, Hon. Justice Martha K. Koome, EGH, has called upon members of the Independent Electoral and Boundaries Commission (IEBC) Selection Panel to approach their duty with utmost integrity, transparency, and commitment to the Constitution.
Speaking during the swearing-in of the Selection Panel, Justice Koome emphasized the critical importance of their role in safeguarding Kenya’s democracy, terming the task as both a privilege and a solemn national duty.
“The responsibility you assume today is not just a legal function—it is a solemn call to serve the people of Kenya and safeguard the integrity of our democracy,” Justice Koome remarked, highlighting that the credibility of elections is foundational to the country’s stability.
The Task at Hand
Justice Koome reminded the Selection Panel of the urgency and gravity of its task. She underscored that the IEBC is the custodian of Kenya’s electoral integrity, and its leadership must exemplify the highest standards of professionalism, impartiality, and independence.
“The future of Kenya’s democracy depends on the integrity of the men and women you select to lead the IEBC,” she stated. “Your guiding principle must be merit, and merit alone. The individuals you select must inspire confidence in the electoral system and uphold the values of transparency, accountability, and inclusivity.”
The Chief Justice also expressed concern over the prolonged vacancy in the IEBC, noting that since January 2023, the lack of commissioners has disrupted critical electoral functions, such as boundary delimitation, voter registration, and by-elections. She called this situation a “democratic disruption” that has denied some constituencies and wards their fundamental right to representation.
Judicial Commitment to Democracy
Justice Koome reaffirmed the Judiciary’s unwavering commitment to upholding the rule of law and ensuring constitutional processes are protected from manipulation or obstruction.
“Justice must never be an obstacle to progress; it must be the very foundation upon which a just and democratic society is built,” she said, adding that all cases delaying the reconstitution of the IEBC were prioritized for resolution.
She urged all stakeholders—Parliament, political actors, civil society, and the public—to ensure the recruitment process is conducted with speed, integrity, and transparency.
A Call for Excellence
The Chief Justice called on the Selection Panel to rise to the occasion with patriotism and a deep sense of duty. She cautioned against succumbing to pressure or partisan interests that could undermine the integrity of the process.
“Your oath of office is not a mere formality; it is a pledge of service to the people of Kenya. The trust of the nation rests on the diligence, fairness, and transparency with which you execute your mandate,” she said.
Justice Koome concluded her speech with a charge to the Selection Panel:
“Let this process be a beacon of integrity, setting a standard for all institutions to follow. The decisions you make will shape not just the 2027 elections, but the future of our democracy.”
A Call to Strengthen Democracy
The Chief Justice reiterated that strong institutions are the bedrock of democracy and called for the IEBC to be allowed to function independently and free from external interference.
As the panel embarks on its mandate to select commissioners for one of Kenya’s most critical institutions, Justice Koome’s words stand as a powerful reminder of the importance of integrity, patriotism, and a commitment to constitutional values.
